"A candidate for trustee must be a resident of the trustee district the candidate seeks to represent".


The education code that DMC has operated under for many many years does not specify a 6 month residence requirement.

"§ 130.0822. ELECTION FROM SINGLE-MEMBER TRUSTEE

h. "A candidate for trustee must be a resident of the trustee district the candidate seeks to represent."

DMC has operated under this code without waiver for quite a while. Why now, does Westergren & Valdez seek an AG Opine.

There is also another clause of the Education Code that reads,

"except where there is a conflict with the provisions of this section, then this section is controlling "

The Voter registration card - many of our politicians are registered to vote here but they are not residents that actually live here as residents. Also, these politicians register to vote in other states.

I have not seen the voter card but suppose it is one issued after she filled out the candidate application. There is a way one lives elsewhere but keeps the voting place in their hometown. I know a few people who live in Corpus Christi but their voting place of record remains in their home town.

Maybe she didnt think she had a chance of winning and was making plans to move back to Kleberg County or maybe the card was reissued by an automated system.

We cant go changing the rules when we dont win and but that is how DMC wins; by cheating.

Every two years I get a new voter registration card, automatically. It always has the same street address (which is correct) but it goes to a PO Box. If I moved to another address, another town or another State it would still be delivered. Since I own my home It would also be valid and I could still legally vote here.

My son who was in the Navy and "LIVED" all around the world, voted here for all 21 of those years. He was a member of several community groups during that time, which required "residency" elsewhere and he also filled those requirements. There is no issue.

Where the lady "VOTES" or voted at any point in time is immaterial, so long as she fulfills the "residency" (where her body resides) requirements.

State law (time of residence) may well apply where the education code (inferior law) is mute. State law is superior to all except federal law...

The Secretary of State cleared her to run.

I think these guys are going to learn a lesson or two....

from the attorney general down. The Secretary of State cleared Ms Garcia to run. If you read the AG opinion you will know what a crook this guy is when it comes to the little people. Carlos Valdez, I cant see how he would obtain Jurisdiction given there is no criminal act. This matter should be processed through existing administrative law.




A Voter Registration in Kleberg While Residing in Nueces?

The question is, which home was her domicile. I have been to her Apartment here in Corpus Christi, it sure looks like it is her primary residence.

I cannot imagine Carlos Valdez even having anything to do with this case, given his history with Mike Westergren and I am told with Joe Alaniz as well.

If Carlos Valdez prosecutes this lady, he is a fool.
